Angry Do not use PlayMart!

We used $20,000 of our hard-earned fundraising dollars last year to purchase a playset from PlayMart (based in Somerset, Ky). This summer the playset grew grass beneath it that looked like it had been fertilized and watered daily.
We called the company, only to be told they were "perplexed".
This led me to examine beneath the playset -- and I found that the rubber mulch they installed was only 1-2 inches deep in many places! (We had been assured the mulch would be at least 6 inches deep). So, not only is the playset area overgrown with grass, it is not even safe for our children due to the insufficient mulch!
I e-mailed the president and CEO of the company 2 weeks ago and have received no response.
Any ideas what my next step should be? The owners are obviously not going to be cooperative in taking care of this problem.

Do you have a signed contract with the company that clearly states that they will install 6" of mulch? If so, contact them again stating that if they do not rectify it before the start of school, they will hear from your attorney and you will also be contacting the local tv station and newspapers.

Our Board of Education finance officer co-signed our contract so that we could use their legal dept if we needed any assistance. Thankfully, all went smooth and we didn't have any issues.

I would try and reach the CEO by phone - emails are too easy to dodge. I would also follow up with a certified letter stating your case and what you would like done to rectify the situation. Good Luck!

Thank you for your suggestions.
We have called the company several times. They will not return our calls.
Our children cannot play on the playset because it has been deemed unsafe.
Apparently the money it would take to fix this problem is more important to them than the safety of our children.
