HI Madhacker,
Generally speaking, a board of education should not be allowed to do this, but it depends on how this particular board has been set up. Its authority and decision-making powers may encompass the formation of these groups. You can request information from the board to get this answer.

Can the Board of Education bar the Principal and teachers from working with an independent PTSO's 501(c)3 Board/nonprofit on grant and funding requests?
