SRP - You are right to question the election results. Your bylaws should clearly spell out the election and voting process. If they were followed accurately, the results stand. If not, then they are invalid.

There are red flags that you saw right away. It should not be one set of rules for one position and a completely different set for another positon. Unless, of course, your bylaws state that and it can be proven.

By waiting for the results and then changing it, it's kind of like being on the play ground and doing one potato, two potato over again because the kid didn't want to be "it".

If she's going to quote the bylaws then she needs to have a copy present and show it to everyone there.

The fact that your bylaws are currently being rewritten is not an issue at this point. Until they're complete and adopted by the group, the current bylaws are your governing document.

By bylaws say:

Section 9 – Election

Membership shall vote on the slate of candidates at a meeting held during the calendar school year and prior to June 1st. The election meeting will be published at the same time as the slate of candidates. Written ballot voting is required. A majority vote of those members present determines those elected. No vote may be cast by proxy. A tie shall be broken by the drawing of lots.

Majority meaning one more than half the votes. I've never seen the 2/3 requirement unless it's a removal of officer vote.

Keep pushing this and make them follow the rules. If they're so brazenly breaking one rule, they're probably breaking a lot more...

I would like to request any info on the following situation. April PTO held Officer elections for 2007-2008, the office of President, Vice-President and Secretary had opposition, The current President established on the floor that the vote had to be 2/3's majority, and that the VP would have to be revoted the vote was 11-10, at the same time the SEC vote was 13-11, however she never mentioned one word that the SEC would have to also be revoted, during the dicussions about the VP one candidate decided to withdraw because she didn't want to have to go through all the trouble of doing it over, anyway, I have questioned the President on several occasions asking her why she did this for one office and not the other, anyway she keeps putting me off and want answer me, Yes I was the the one for SEC with 11 votes, the election was not carried out according to the bylaws and we are now changing the bylaws, but the question still remains how could this election be considered legal and binding when it fact it was nothing more than suiting the needs of those on the PTO at present. We have installation of new officers tonight and again the current President who was also elected as next years President will not answer me. Any advise would be great.
