I know that a teacher cannot hold officer postions but was wondering about substitute teachers that sub on a regular basis. Can these subs hold office even if they are being paid by the school district on a regular basis?
Not sure if this would be considered a conflict of interest. Any help with trying to figure this out would be greatly appreciated.

Our PTS allows for teachers to hold a position. Actually our 1st/2nd grade teacher has held the Treasurer position for two yrs now. She does a fantastic job! I personally don't see a conflict of interest. But that's just my opinion.

If your by-laws state that no teacher cannot hold office, it doesn't matter if the person in question is a regular full time teacher, a full time substitute teacher, a regular part time teacher, or a substitute part time teacher. No is no. The source of their funding is inconsequential.

We do not have this in ouir by-laws -- we probably should though since teachers receive money from us for their classroom.... Might have to make a change to the by-laws.

Since there is a question on the definition as it applies to your bylaws, the way to decide it is to bring the question to your membership.
If your org. can get a majority to agree on what that definition is, then apply it to your predicament.
Then, amend your bylaws so that this doesn't come up again.

Our bylaws are pretty laxed so it is time to rewrite the bylaws so this issue doesn't come up again.
