Legalites of taking pictures and selling them

If they're offering to sell the pictures to ANYONE, I think that's a problem. If they're offering to sell each child's picture only to that child's parent, your "opt out" option is simply to decline, and I don't see a problem with that.

The principal initiated this. The PTA had no knowledge of this. The paperwork that parents receive regarding photos is a media release and it states that unless you send a letter to school opting out they can publish your childs picture in the paper. It says nothing about selling your childs photo. And it being the first day of school parents weren't even given the opportunity to opt in or out. In this situation they took the individual childs photos on the first dayand are selling them back to the parents.

Hmmm. You may have a point here. Usually paperwork goes out on the first day of school allowing parents to opt out/opt in to photos being take of their children. Or, if it is an official school picture day, you would have been notified ahead of time. Do you know was this a school initiative or a PTO event?

We have a new principal who is obsessed with fundraising. We came back to school and on the first day they took individual pictures of every child. On friday a flyer came home offering to sell these photos for $2 each. I understand wanting to fundraise but I and other parents are upset that we did not get any notification that they were going to take pictures of our kids in the first place and then turn around and sell them back to us! Some parents said this is not legal since they are selling the pictures and they did not get the opportunity to opt out of the picture taking. Anyone know if this is legal or not?
