Missing NSF checks/Is the past treasurer accountable for?

Ugh. If you don't have the checks or reliable records of who bounced checks, it doesn't sound like you can recover the money. No proof. Time to write it off, sadly. But, this is a great time to tighten up procedures for the future. How about an audit? Typically, a PTO would conduct an audit at the end of school year. I'm not sure this would help in this specific case, but your situation might also suggest that it's a good idea to bond your new officers.

Is it possible she threw the checks away, not realizing the importance of the physical documents, and now is too embarrassed to admit her mistake? Poor procedures are often to blame for similar problems, not conscientious fraud or purposeful mismanagement. I would be inclined to focus my energy on drafting written procedures and control forms for the treasurer and fundraising chair to minimize the risk in the future. Good luck!

I have copies of the past statements but getting copies of the missing checks is not possible. We don't know who wrote the bad checks either. The banks said it would cost $50 an hour to try to look this up, but it would be Very time consuming and not worth the money spent in the long run. We have an attorney available to help us, but he will only get involved if we have the original NSF checks. So we are back to the problem of getting the checks or the money from the former Treasurer.
As a group, we just want to be careful how we approach this situation. We don't want to get ourselves in trouble legally. This PTO group is not sure how much we can hold the former treasurer responsible. More thoughts are welcome. [img]smile.gif[/img]

Have you talked to the bank? They should be able to get you copies of old statements.

I wonder if they would be able to provide you with records of the NSF checks that hit your account this year. It might be a starting point.

The "misplaced" NSF checks were written by other people. This former treasurer also "can't find" the past years bank statement. There is missing money from a past fundraiser, what was collected and what was actually deposited is two different amounts. This is a mess, and we want to put pressure on the former treasure to "locate" these missing NSF checks or make her reimburse the PTO for the full amount. As a group, we know this is not going to be pretty, but we are talking about more than $1,000.00 being lost. If you have any suggestions I am open to hearing them.

Are these checks that other people wrote that were returned nsf and the treasurer misplaced them? Don't think you've got an legal recourse against the treasurer for being dis-organized and forgetful. Now if these are checks she wrote herself - you could certainly go after her for the funds. Could you clarify? :confused:

The past PTO treasurer "misplaced" over $600.00 worth of NSF checks. Is there anything we can legally do to either get the checks back, or hold her accountable for the missing money? Aside from the missing checks, there is missing money from the same fundraiser. Because the fundraiser was not handled properly, I don't believe we can hold the former treasurer accountable for the missing funds. Any advise will be greatly appreciated!
