Question about a parent owing money wanting to run for executive board

As a PTO Treasurer, I see people bounce checks sometimes, and when they admit they made a mistake and cover it right away, that is one thing. But to have that much outstanding for that long, tends to make me quesiton that person's integrity, ability to properly manage business for the group, and quite frankly, their motivation. What type of person collects money upfront, then passes a bad check and does not pay it back? I count that as stealing money from the kids, and I would not want that person anywhere near any decision making position on the board and certainly not in any position where they had access to the funds. I don't think the bylaws apply here, and if they do, then you need to hold a special meeting or whatever method you use to amend them. You could always first point out to her that her debt is way over due and that unless she pays up, you are going to hold a meeting about it- then see if she wants to correct the situation.

I didn't say we did. I was just pointing out that we don't know that she ordered, "things that you know you dont have enough $$$ to cover for it at the time payment is due." Basing any answer on that assumption isn't really fair to the OP or the candidate.

To me it sounds as though this person collected money for a fundraiser from people she sold to, but then maybe used the money on something other than to turn it into the school?

I would have to say that I would not want her running at our school. At our school, she would not be allowed to participate in future fundraisers. I guess we have quite a bit of this. We decided to sell and collect $ up front. The problem we ran into was parents sold and then kept the money for themselves. Then the people who paid them for their purchases wanted to know where their merchandise was.

To me, it sounds as though this is the type of problem you are stating.

Nearly six months and only paid $15 of pre-collected money? I would be very weary and simply state that in order to run, all money must be paid in full in advance.

one never hears all sides or all the facts. one can only give input or opinions based on whats been posted or asked, and based on what little info there is. if you had to have all the facts before posting an answer, we wouldnt have any responders.

We don't actually know that that's what happened though.

Whether a board can vote to set a specification as to when a new officer officially takes over is dependant upon the Bylaws. For example, my group's Bylaws specifically state:

"The Board of Directors shall have the entire charge, control and management of the corporation and its property and may exercise all or any of its powers."

So it, as always, comes down to a group's Bylaws.
